1. This page (together with the documents referred to on it) explains the terms and conditions on which “JUNONA KATYA GENEVA” EOOD (from now on called “JUNONA”, the “Company” or the “Seller”) sells any of the clothes and accessories (bellow called “Products” or “Goods”) listed on its website: https://junonastore.com.

2. These terms and conditions (bellow the “Terms” or the “Rules”) apply to all users of JUNONA Online Store (bellow the “Store’) accessible on https://junonastore.com (the “Website”) and establish the principles of registration and use of an account on the Website, ordering goods from the Store, as well as the conclusion of contract of sale of goods from the Store.

3. Pleasе read the Terms very carefully before ordering any products from the Website.

4. By placing an order through the Website, you confirm that you accept the current terms and conditions together with the documents referred hereto. If you do not agree these terms and conditions, please do not use the Online store.

  • INTRODUCTION

1. Each user of the Store can access the Terms at any time by clicking on the link "General terms and conditions" on the Website of the Store.

2. The information about the offered products, such as image, description and final price, is a proposal for concluding a contract for sale of goods. By clicking on the "Order now" button on the Website, the user proceeds to enter into a contract for the sale of goods in the Online store and will be redirected to the processing of the payment.

3. The Website provides detailed information about the characteristics of the products, their price, material from which they are made, etc. The images and exhibitions of the products shall serve as representations of the models of the goods specified therein.

  • PRINCIPLES OF USING THE STORE AND PLACING AN ORDER

1. JUNONA makes it possible to conclude contracts for the sale of goods on the Internet and provides other services provided for in these Rules.

2. All Customers of the Store (called also “Clients”) should be over 18 years of age and have the legal capacity to enter into binding contracts. When placing an order on https://junonastore.com, you acknowledge that all details you provide to JUNONA are true and accurate, that you are an authorized user of the credit or debit card used to pay for your order and that there are sufficient funds to cover the cost of the ordered goods and services, as well as their delivery.

3. By using the Website in order to place an order you will follow simple and understandable steps provided by JUNONA. The order will be processed just by following the steps for making a purchase.

4. The information provided by you as a Client in the course of the order must be accurate, up-to-date and clearly defined. JUNONA reserves the right to refuse to fulfill an order if the information provided is inaccurate to the extent that it is impossible to fulfill the order, and in particular does not allow the delivery of the shipment. Before refusing to place an order, JUNONA attempts to contact the Customer to verify the data provided by him in connection with the requested order, as far as possible.

5. The Store shall take all possible and required by the applicable legal provisions technical and organizational measures for the protection of consumer personal data, in particular those that prevent the receipt and modification by unauthorized persons of data provided during registration. Visitors and Customers of the Website confirm that they are familiar with the Online Store Privacy Policy and understand the principles and purposes of processing their personal data on the Website. 6. A user who has used a service of the Store has an obligation:

(a) Not to provide or transfer content that is prohibited by law;

(b) To use the services of the Store in a way that does not disrupt its operation;

(c) Not to distribute or publish unsolicited commercial information in the Store;

(d) To use the services of the Store without creating significant difficulties for other users or for the administrator of the Store;

(e) Use the content published on the Store's website for its own use;

(f) Not to place false or fraudulent orders. All orders which give grounds to believe that they are fraudulent or incorrect shall be canceled by the administrator and communicated to the competent authorities.

  • CONCLUSION OF CONTRACT OF SALE OF GOODS

1. The Store allows the ordering of goods as follows:

(a) on the Store's website (online), using the ordering procedure;

(b) by sending an email to: marketing@junonastore.com, contained the order’s details, including personal measurements and stylistic desires when the Client chooses to order a custom-made product.

2. The Store accepts orders made online, 24 hours a day, seven days a week. Orders requiring confirmation or additional arrangements by email will be accepted on business days between 9:00 and 17:00. Orders placed on non- business days will be processed on the first business day following the day of the order. For the purposes of these Terms, business day means any day other than Saturday, Sunday or other day on which commercial banks are authorized or required by law to remain closed.

3. The condition for placing an order is to fill in a form with all the data necessary for the transport and the payment of the products and their delivery.

4. To place an order, select product from the Store, paying special attention to the quantity, color, size, then go to the "Cart" section and continue the ordering procedure by selecting the appropriate options for further action.

5. Until the confirmation of the selection of the products through the button "Order now", you may make changes to the products specified in the order, as well as change the address and coordinates for sending the shipment or for drawing up an invoice. The confirmation of the order by clicking the button "Order now" is equivalent to acceptance of the obligation to pay the price of the goods, the costs for their delivery and import duties and taxes if due.

6. When placing an order, the Customer receives at the specified email address confirmation message containing data about the order, including the number of ordered Goods, the price of the ordered Goods and the delivery, the delivery address of the Client. The message indicates the number of the order and its status, which could be ‘processing’, ‘canceled’ or ‘sent’

7. The Store reserves the right to refuse to fulfill the order under the contract of sale when:

(a) the Buyer's contact details were inaccurate to the extent that delivery of the goods was not possible,

(b) the transaction is not authorized in the electronic payment system of the Website, or

(c) the payment for the order is cancelled after the submission of the order.

(d) the Client has provided incorrect measures when using the made-to-measure service and has not corrected this within 3 (three) days or other term given by JUNONA.

(e) the Client has not provided the measurements form and/or the declaration under point 2 in V. Made to measure section or the form and/or the declaration were not filled and/or signed.

8. The enterprises/companies follow the same steps as described above for placing an order but for receiving an invoice they must send their company data by using the following contact email address: marketing@junonastore.com.

  • MADE TO MEASURE

1. To ensure the highest level of attention to its Customers, JUNONA offers a made-to-measure service meaning that certain products from the Website can be ordered custom-made by using Client’s personal measurements and stylistic desires.

2. This exclusive made-to-measure service can be requested by selecting the option ‘MADE TO MEASURE’ from the Responsive panel ‘*Size’. After placing the order, the Client will receive a measurements form and a declaration of which both should be filled in with the respective data and sent back to email address: marketing@junonastore.com. JUNONA Team are at the Client’s service for any information needed for making a made-to-measure order.

3. JUNONA’S custom-made products must be subject to additional arrangements. The price, execution term and delivery time must be arranged in the correspondence between JUNONA and the Client. JUNONA always do its best to maintain reasonable term for execution.

4. The Customer should give precise and accurate information for the customized order following the Sizes Guide on the Website and the instructions of JUNONA Team. JUNONA recommends the measures to be determined by a professional tailor. JUNONA shall not be liable for any loss or additional expense relating to mistakes and/or changes in the Customer’s measurements.

5. Each custom-made product is made specifically to the Client’s specifications and preferences and such orders can't be cancelled or returned. The only exception is if the product is defective. In the last case Customer should contact JUNONA Team for information regarding a defective product.

6. It is subject of JUNONA sole and only discretion if any product could be subject to the made-to-measure service.

  • RIGHT OF WITHDRAWAL

1. As a Customer of  https://junonastore.com and if you are an individual, not an entity you may cancel a contract (except of contracts for custom-made products) at any time within 14 calendar days starting from the day after you received the products. In order to exercise your right of withdrawal, you should select the product you want to return by using the respective option (the ‘Return button’) from the Website accessible in ‘My account” -> ‘My orders” section. The last will generate return request to JUNONA.

2. Upon receipt of the withdrawal, JUNONA will send back to you a confirmation of the return request received and will give you instructions and further information for further actions.

3. If you as a Customer wish to cancel your order within the cancellation Period of 14 calendar days, then you will receive a full refund of the price paid for your order within 14 days starting from the day we receive the products back from you. Please bear in mind, that due to the specific nature of our products, we have the right to deduct or refuse your refund in case the product was damaged, used or washed by you.

4. All refunds of the product sale price (delivery charges are not refundable) will be credited to the same credit card or PayPal account used for the original purchase within 5 business days after receiving the respective product from JUNONA. The term for processing the payment on the client's account may vary depending on the conditions of the respective payment institution, but usually don’t exceed 15 (fifteen) business days.

  • DELIVERY AND RECEIPT OF GOODS

1. The goods are delivered to the address specified by the Customer in the order. The costs for sending the purchased products shall be borne by the Customer, of which the Customer shall be notified by the JUNONA Team.

2. Customers indicate the place of delivery of the chosen goods (country, region, town, etc.) by selecting from the options on the page and fill in all required fields in the form. The time for delivery depends on the place (country) and normally does not exceed 25 working days from the acceptance of the order for execution.

3. If the Customer is shopping outside a member state of the European Union, the products may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. The Customer will be responsible for paying any such import duties and taxes.

4. Please note that JUNONA has no control over the aforementioned charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. JUNONA will not be liable for any breach by you of any such laws.

5. JUNONA uses National Post Service and DHL for each shipping option to ensure the Client receive the order in the proper condition. All orders are typically processed within 2 business days from the day the order is confirmed, once billing and credit information have been authorized and verified by our credit card processors (PayPal). Please provide complete billing and shipping information to avoid a possible delay in the delivery of your package. JUNONA shall not be liable for any direct loss or delays arising by a fault of the courier/ postal operator.

6. Information regarding the standard delivery rate and the approximate delivery time depending on the place of delivery is published on the Website in the Delivery Section.

  • PRICES AND METHODS OF PAYMENT

1. The prices payable for the products are shown on the Website. The prices advertised on the Website are final end-user prices but DO NOT include delivery charges and import duties and taxes if due. Delivery charges are shown separately when placing the order but they must also be paid in advance.

2. Prices are subject to change without any notice but changes will not apply to orders which JUNONA has already accepted. JUNONA reserves the right to change the prices of goods in the Store, to introduce new goods for sale, to conduct and terminate promotional advertising campaigns on the Website of the Store or to make changes in products..

3. Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you. If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

4. JUNONA is under no obligation to provide the product to you at the incorrect (lower) price, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a miss-pricing.

5. The Customer pays the value of the ordered goods, together with the delivery costs only in the form of electronic payment (American Express, Visa, Master Card, International/Maestro credit and debit cards, PayPal account, etc.) or a bank transfer. The price of the products in the Store is quoted in EUR and includes all inherent components (except for delivery costs, import duties and taxes if any). Be aware that your credit card company uses exchange rates if you pay in another currency than EUR. The processing of your order will begin after we have received the payment for the order.

6. If your payment transaction is successful, you will receive an email with a description of the order. If you fail to receive this message, there might be a temporary network problem or a spelling mistake in the email address. In either case, you are advised to contact JUNONA at the following address: marketing@junonastore.com.

  • COMPLAINTS ABOUT THE GOODS

1. The products offered in the Store are completely new and original. “JUNONA KATYA GENEVA” EOOD is responsible for physical and legal defects of the Goods according to art. 105 and Art. 122 of the Consumer Protection Act.

2. Although JUNONA make every effort to keep sufficient stock of products listed on the Website, occasionally the Store do sell out of certain products. If the product you've ordered is out of stock, JUNONA will notify you via email. Any changes will be reflected in your order total as well as your shipping confirmation.

3. JUNONA makes every effort to ensure the proper functioning of the Store, based on the available technical expertise and undertakes to eliminate within a reasonable time any irregularities reported by Customers.

4. For each item purchased in the Store, a complaint may be filed, subject to the terms and conditions of appeal specified in the relevant legal provisions, if there are deficiencies that make it inconsistent with the contract of sale.

5. If the purchased products have defects, the Client has the following rights:

(a) to make a statement for cancellation of the contract;

(b) to require the product to be replaced by another without defects;

(c) to require the product to be repaired;

6. The complaint should be submitted by sending an email describing the defect of the purchased Products. Within 14 working days from the receipt of the complaint from JUNONA, the Customer will be notified of the decision on the complaint or will receive further instructions how to send the defected Products to JUNONA in order to be established the defect, subject of the complaint, respectively the defect to be compared or the product to be replaced.

7. In case the claim is not satisfied, the products should be returned together with an opinion on the unfoundedness of the complaint. The delivery costs in that case should be payed from the Client before returning of the product. In case of refusal of the Client to pay the delivery costs, the product will be discarded.

  • INFORMATION ABOUT THE SERVICES PROVIDED ELECTRONICALLY

1. The Store provides the Customers with the following services electronically:

(a) Possibility for concluding online contracts for the sale of goods in the Store, according to these Terms,

(b) Ability to create Customer profiles in the Store,

(c) Sending the ordered commercial information about the goods.

2. The Customer has the right to withdraw from contracts for the sale of goods in accordance with the relevant provisions of the law and in the principles set out in these Terms. In addition, the Customer has the right at any time to request termination of the services provided by the Store, referred to in point 1, letters (b) and (c) above.

3. The technical conditions for the provision of online services by the Store are as follows:

(a) Internet access,

(b) use of a web browser that allows editing of hypertext documents (e.g. Internet Explorer, Opera, FireFox or similar);

(c) availability of email address.

4. Complaints about services provided electronically can be addressed to marketing@junonastore.com. or by phone +359 87 826 9304.  The Client's complaint must contain the name of the recipient of the service and a brief description of the problem. The Store should make every effort to review the complaint as soon as possible, but no later than 14 business days after receipt. The Customer should be notified of the manner in which the complaint has been handled, at his option by telephone or via e-mail sent to the e-mail address specified by him.

  • RESPONSIBILITY

1. By accessing this website, you agree that JUNONA shall have no liability to you for any direct, indirect, incidental or consequential losses including without limit loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.

2. Without prejudice to the foregoing, JUNONA’s total aggregate responsibility to you under and/or arising in relation to using the Website and concluding a contract with JUNONA shall not exceed the amount paid by you for the products.

  • INTELLECTUAL PROPERTY RIGHTS

1. The content on this Website, such as text, graphics, images, photographs, illustrations, video clips, trademarks, trade names, logos, designs or any other material (collectively called “Contents”) is protected under domestic and foreign intellectual property laws. JUNONA owns all rights and/or license in and to the Contents. Any use of the Contents not expressly permitted by these Rules is a breach of these Rules and may violate copyright, trademark and other laws.

2. By using this Website you acknowledge that, except as stated herein, none of the Contents may be copied, reproduced, distributed, republished, downloaded, displayed, posted, transmitted, modified, or created into derivative works in any form or by any means without the prior written permission from JUNONA.

  • INDEMNITY

1. You agree to indemnify, defend and hold harmless JUNONA, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

  • WRITTEN COMMUNICATIONS. NOTICES

1. Applicable laws require that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

2. All notices given by you to us must be given to us at marketing@junonastore.com. We may give notice to you at the email you provide to us when placing an order. Notice will be deemed received and properly served immediately up to 48 hours after an email is sent. In proving the service of any notice, it will be sufficient to prove that such a notice email was sent to the specified email address of the addressee.

3. All notices given by you to us must be given to us at marketing@junonastore.com. We may give notice to you at the email you provide to us when placing an order. Notice will be deemed received and properly served immediately up to 48 hours after an email is sent. In proving the service of any notice, it will be sufficient to prove that such a notice email was sent to the specified email address of the addressee.

  • TRANSFER OF RIGHTS AND OBLIGATIONS

1. The contract between you and us is binding on you and us and on our respective successors and assigns.

2. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without JUNONA’s prior written consent.

3. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

  • SEVERABILITY

1.  If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

2. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause/sub-clause as is permitted by law.

  • OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

1. JUNONA has the right to revise and amend these terms and conditions from time to time as a reflection of changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities or for any other reason in our sole discretion which JUNONA may decide.

2. You as a Customer will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the dispatch confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).

  • FORCE MAJEURE

1. In case of the occurrence of a force majeure event the terms and conditions of the contract concluded between JUNONA and a Customer shall stand terminated with neither the Customer nor JUNONA being entitled to any compensation.

2. JUNONA considers force majeure events as war, mobilization, political revolt, terrorism, strikes, legislative changes, natural catastrophes, the lack of on-time delivery by suppliers to JUNONA, and any other circumstances that are beyond JUNONA’s control.

  • JURISDICTION

1. The terms and conditions contained herein and all matters connected with any order you place on the Website are governed by the laws of Republic of Bulgaria and the respective European acts if applicable, and you agree to submit all matters connected with or arising out of the use of this website and/or any order you place on the Website to the exclusive jurisdiction of the Bulgarian courts.

2. For matters not covered by these Rules, the relevant provisions of the Bulgarian legislation, Regulation (EC) No593/2008 of the European Parliament and of the Council of 17June 2008 on the law applicable to contractual obligations (Rome I); Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights (‘The Consumer Rights Directive’), as well as the provisions of other laws, conventions and international acts applicable to the activity and the operation of the Store.

  • INFORMATION ABOUT THE SELLER

1. “JUNONA KATYA GENEVA” EOOD (bellow “JUNONA”, the “Company” or the “Seller”) is a sole-owned limited liability company established and existing under the laws of the Republic of Bulgaria, having its seat and management address at: 6400 Dimitrovgrad, 9A, “Peti Noemvri” Street, registered under Unified Identification Code (UIC) 126580846 at the Trade Registry kept by the Bulgarian Registry Agency.
